1. General information

 

This document sets out the terms governing the use of www.culturaft.ro (the “Website”). The Website is administered by CULTURAFT ASSOCIATION, headquartered in Corbeanca Village, Corbeanca Commune, 43B Viitorului Street, 1st floor, room no. 3, Ilfov County, registered in the Register of Associations and Foundations under no. 35/28.10.2013, tax identification number 28664343, intra-Community VAT identification number RO 29609304, represented by Henriques dos Santos Nelson Jose, Vice-President, hereinafter referred to as the “Association” or “CULTURAFT”.

By accessing and using the Website, the user confirms that they have read these Terms and Conditions. If the user does not agree with them, they should discontinue use of the Website.

2. Purpose of the Website

 

The Website is intended to provide information and present CULTURAFT’s activities, projects, initiatives and programmes, and to facilitate communication with persons interested in the Association’s activities.

Information published on the Website is general in nature. Unless expressly stated otherwise, it does not constitute a contractual offer and accessing the Website alone does not create contractual obligations for the Association.

3. Use of the Website

 

Users must use the Website lawfully and in good faith, without adversely affecting its operation, security or content, or the rights of the Association or third parties.

  • Users must not submit unlawful, abusive or third-party-rights-infringing information through the contact form.
  • Attempts to gain unauthorised access to the Website’s technical infrastructure are prohibited.
  • Content may not be copied, reused or distributed for commercial purposes without the rights holder’s permission, except where permitted by law.

4. Contact form

 

The Website provides a contact form. Users are responsible for the accuracy of the information submitted and should not include excessive personal data, sensitive data or confidential information that is unnecessary for handling their request.

The processing of data submitted through the form is described in the Privacy Policy.

5. Donations, sponsorships and support

 

Where the Website presents ways to financially support CULTURAFT’s activities, donations, sponsorships or other forms of support are subject to the terms and legal provisions applicable to each transaction. Publishing information on ways to provide support does not make the Website a payment-services platform.

Texts, graphic elements, visual identity, photo and video materials, documents and other elements published on the Website may be protected by copyright, related rights, trademark rights or other intellectual property rights belonging to CULTURAFT or third parties.

Use of such content beyond the limits permitted by law requires the prior permission of the relevant rights holder.

The Website may contain links to pages or services operated by third parties. CULTURAFT does not control their content, availability, privacy practices or security and is not responsible for the way those services operate.

8. Website availability and security

 

The Association takes reasonable steps to keep the Website operational and secure but does not guarantee uninterrupted availability or the complete absence of technical errors. Access may be temporarily suspended for maintenance, updates, security purposes or causes beyond the Association’s control.

9. Limitation of liability

 

To the extent permitted by law, CULTURAFT is not liable for loss arising solely from temporary inability to access the Website, improper use of the Website or content of external services linked from it.

10. Data protection and cookies

 

The processing of personal data is described in the Privacy Policy. Information about cookies and similar technologies is provided in the Cookie Policy.

11. Changes to these terms

 

CULTURAFT may update these Terms and Conditions to reflect changes to the Website, its activities or the applicable legal framework. The applicable version is the version published on the Website at the time of use.

12. Governing law and contact

 

These Terms and Conditions are governed by Romanian law and applicable European Union law. Any dispute will first be addressed amicably and, if no resolution is reached, by the courts having jurisdiction under applicable law.
